Guest Referral Terms

The Kinsfather Studios Guest Referral Program (the “Guest Referral Program”) gives existing Kinsfather Studios Users (each, a “Referring User”) the opportunity to earn rewards by referring new Guests (each, a “New Referred Guest”) to Kinsfather Studios. By participating in the Guest Referral Program, you are bound by these Guest Referral Terms and indicate your agreement to them in their entirety. You cannot participate in the Guest Referral Program if you do not agree to these Guest Referral Terms in their entirety or if doing so would violate any applicable law or regulation. All of Kinsfather Studios's decisions in connection with the Guest Referral Program are final and binding. These Guest Referral Terms are incorporated in, part of and subject to the Kinsfather Studios Services Agreement, and any capitalized term used but not defined in these Guest Referral Terms shall have the meaning given to it in the Kinsfather Studios Services Agreement.

1. Who can participate

To qualify to receive rewards under the Guest Referral Program, a Referring User must:

Have an existing, valid account with Kinsfather Studios
Keep its account in good standing
Agree to and be in compliance with the Kinsfather Studios Services Agreement and these Guest Referral Terms
Be a resident of the United States
Be at least 18 years of age
Be legally able to participate in the Guest Referral Program

2. How to earn rewards

To participate in the Guest Referral Program, once you have created your Kinsfather Studios account, visit https://www.KinsfatherStudios.com/referrals and follow the on-screen instructions to start referring. You will be provided a link which you can share with your friends and colleagues as often as you want. If a new user (i.e. someone who has not previously registered for a Kinsfather Studios account) registers for a Kinsfather Studios account directly through your link, agrees to and abides by the Kinsfather Studios Services Agreement, and completes a Qualifying Booking as described below, you as the Referring User will receive a Kinsfather Studios credit worth $50.00, subject to the below, and the New Referred Guest will receive a $50.00 discount off their first Booking on Kinsfather Studios, subject to the below.

If a New Referred Guest clicks multiple referral links, the last referral link that the New Referred Guest clicked before registering its Kinsfather Studios account will receive credit for the referral.

3. Qualifying Bookings

Rewards for Referring Users under the Guest Referral Program will only be issued where a New Referred Guest makes a “Qualifying Booking”, which means a Booking consisting of the following:

The Booking Price is greater than $150.00
The Booking is not cancelled
The Booking is for a Space located in the United States
It is the New Referred Guest’s initial Booking on Kinsfather Studios
The Referring User is not affiliated with the booked Space

4. Collecting rewards

Credits under the Guest Referral Program will be issued to Referring Users as follows:

$50.00 worth of Kinsfather Studios credits shall be issued for each New Referred Guest who completes a Qualifying Booking
Each Referred User shall be limited to a maximum of $5,000.00 worth of Kinsfather Studios credits
Credits will be issued after the New Referred Guest’s Qualifying Booking is completed
It may take up to 7 business days following the completion of the Qualifying Booking for the credits to appear in the Referred User’s Kinsfather Studios account

Discounts under the Guest Referral Program will be issued to New Referred Guests as follows:

$50.00 discount shall be applied to the New Referred Guest’s initial Booking on Kinsfather Studios (i.e. the Qualifying Booking described above)
The discount shall be automatically applied at Booking checkout
New Referred Guests can use the discount only once
The discount cannot be combined with any other Kinsfather Studios discounts that may be applicable

Kinsfather Studios Users are completely and solely responsible for both the determination and payment of any taxes imposed on them that may result from rewards earned under the Guest Referral Program.

5. Use of credits

Any Kinsfather Studios credits issued under the Guest Referral Program may only be used (i) as a discount for the future booking of Spaces located in the United States and (ii) up to the amount of the Booking Price for each applicable Booking. Such credits have no monetary value, and they may not be redeemed, transferred or exchanged for cash. Credits are not transferable, tradeable, salable, or auctionable. If the Guest Referral Program is terminated by Kinsfather Studios, Referring Users will have 30 days to use any credits before they are forfeited. If a Referrer User's Kinsfather Studios account is cancelled or otherwise terminated for any reason, unredeemed credits shall be forfeited immediately.

6. Promoting referral links

Referral links under the Guest Referral Program are intended to be shared between friends and colleagues. Publishing such links, such as through mass emails or spam, advertising, forums, or coupon sites, may result in disqualification from the Guest Referral Program.

Kinsfather Studios Users cannot refer themselves or create multiple, fictitious or fake accounts with Kinsfather Studios. No Kinsfather Studios User may use the Guest Referral Program to violate any applicable law or regulation, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Guest Referral Program. In addition, you may not (i) tamper with the Guest Referral Program, (ii) act in an unfair or disruptive manner in connection with the Guest Referral Program, or (iii) use any system, bot or other device or artifice to participate or receive any benefit in the Guest Referral Program. If Kinsfather Studios believes that a referral link associated with a User’s account was used in any manner prohibited herein, Kinsfather Studios shall have the right to remove all credits and/or discounts associated with that account and remove the User from the Kinsfather Studios Platform immediately and without notice to the User. Caution: any attempt to deliberately damage or undermine the legitimate operation of the guest referral program may be in violation of criminal and/or civil laws. should such an attempt be made, Kinsfather Studios reserves the right to seek remedies and damages (including attorneys’ fees) to the fullest extent of the law, including criminal prosecution.

7. Termination & updates; suspensions

Kinsfather Studios reserves the right to terminate, suspend or modify the Guest Referral Program at any time and for any reason. Kinsfather Studios reserves the right to update or modify these Guest Referral Terms, including the rewards amounts or qualifying activities, at any time upon notice to you. Any modifications to these Guest Referral Terms will be posted to KinsfatherStudios.com and will be effective at the time of posting. Continuing to participate in the Guest Referral Program will constitute your consent to any modifications to these Guest Referral Terms and/or the Guest Referral Program. Kinsfather Studios reserves the right to suspend or disqualify Users from the Guest Referral Program at any time for suspected abuse, fraud or violation of these Guest Referral Terms or the Kinsfather Studios Services Agreement. Referrals and credits associated therewith are subject to verification or investigation by Kinsfather Studios at any time and for any reason. Kinsfather Studios may withhold or invalidate any potential credits resulting from referrals it deems fraudulent, suspect or otherwise in violation of these Guest Referral Terms at its sole discretion. You are responsible for notifying Kinsfather Studios if you believe that the number of referral credits in your account is incorrect.

8. Liability

The laws of certain jurisdictions do not allow the limitation of liability or certain damages for consumers. If these laws apply to you, some or all of the below exclusions or limitations may not apply to you and you may have additional rights.

Under no circumstances or any legal theory will Kinsfather Studios or its agents, directors, shareholders, members, partners, managers, officers, employees, information providers, distributors, vendors, contractors, attorneys, or affiliates (collectively, the “Kinsfather Studios affiliates”) be liable to you or any third party for any damages (whether direct, indirect, general, compensatory, incidental, consequential, special, punitive, exemplary or otherwise), injury, claim or liability of any kind or character based upon or arising out of or in connection with the guest referral program or these guest referral terms, even if Kinsfather Studios has been advised of the possibility of the same. If you are dissatisfied with the guest referral program, your sole and exclusive remedy is to discontinue your participation therein. To the fullest extent permitted by applicable law, the Kinsfather Studios affiliates’ maximum liability arising out of or in connection with the guest referral program, regardless of the cause of action (whether in contract, tort, breach of warranty, or otherwise), shall be $100.00.

To the fullest extent permitted by applicable law, you will indemnify, defend, pay and hold the Kinsfather Studios Affiliates harmless from and against any and all third-party claims, liabilities, losses, damages and related expenses (including reasonable legal expenses and attorneys’ fees) arising from or related to (a) the Guest Referral Program or (b) your breach of any of your representations, warranties or obligations under these Guest Referral Terms or the Kinsfather Studios Services Agreement. Kinsfather Studios reserves the right, in its own sole discretion, to assume the exclusive defense and control at its own expense of any matter otherwise subject to your indemnification. You will not, in any event, settle any claim or matter without the prior written consent of Kinsfather Studios.

Host Referral Terms

THE HOST REFERRAL PROGRAM HAS BEEN TERMINATED AS OF APRIL 2, 2021. ANY REFERRED LISTINGS THAT ARE SET LIVE AFTER THIS DATE WILL NOT BE ELIGIBLE FOR REWARDS.

1. Who can participate

To qualify to receive rewards, a referring host must have:

Signed up with Kinsfather Studios
Kept their account in good standing
Agreed to and followed the Kinsfather Studios Service Agreement
Agreed to and followed the Kinsfather Studios Referral Terms outlined here

2. How to earn rewards

Referring hosts can earn rewards if the new referred host:

Clicks the referring host’s link to sign up
Agrees to the Kinsfather Studios Service Agreement
Completes a qualifying booking
Has not signed up with Kinsfather Studios before or submitted listings

If a new referred host clicks multiple referral links, the last referral link that the new referred host clicked before signing up will receive credit.

3. Qualifying booking

Referring hosts will receive a reward for qualifying bookings where:

The new referred host accepts the booking within their first 90 days after their first listing is set live by the Kinsfather Studios team
The booking is not cancelled
The booking is not with the referring host
The new referred host is not booking themselves on the same or an additional account

4. Collecting rewards

For qualifying bookings, the referring host will receive the reward in effect at the time that the new referred host signs up with the referring host’s link.

Rewards will be paid in dollars (USD) and calculated as:

5% of the new referred host’s space subtotal after any discounts provided by the host (such as an 8+ hour discount)
Space subtotal does not include additional charges, including but not limited to cleaning fees, catering, furniture rental, overtime, sales tax, or gratuity.

Rewards will be transferred to the referring host three days after a qualifying booking ends to the bank account on-file with Kinsfather Studios.

If Kinsfather Studios cannot complete the reward transfer—for instance, if the bank account on-file is invalid or additional identity information is required to make the transfer—the balance of the reward may be held until the additional information is provided.

The referring host will be responsible for any taxes that result from a reward.

5. Promoting referral links

Host referral links are intended to be shared between friends. Publishing the link, such as through mass emails or spam, advertising, forums, or coupon sites, may result in disqualification from the Host Referral Program.

6. Termination & Changes

Kinsfather Studios may terminate or change the Host Referral Program at any time and for any reason.

Kinsfather Studios may suspend individual referring hosts from the program at any time for suspected abuse, fraud, or violation of the Kinsfather Studios Service Agreement. Kinsfather Studios may investigate referrals for any reason and modify rewards at Kinsfather Studios’s sole discretion as is fair and appropriate.

7. Updating the terms

Kinsfather Studios may update the terms of this program, including the bonus amount or qualifying activities, at any time without prior notice. The changes will be posted to KinsfatherStudios.com and will be effective at the time of posting. Continuing to participate in the Host Referral Program will constitute consent to the program.

This program and your use of Kinsfather Studios is subject to the Kinsfather Studios Services Agreement.
